By registering for an account, accessing, or using SmartTagAI ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

SmartTagAI provides AI-powered content generation, duplicate content checks against past history, and scheduling tools for publishing to third-party social media platforms including X (formerly Twitter) and Bluesky. We reserve the right to modify, update, or discontinue features of the Service at any time without prior notice.

3. Accounts & Authorization

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must be at least 13 years old (or the legal age in your jurisdiction) to use the Service. We reserve the right to suspend or terminate accounts that violate these Terms or threaten service security.

4. Subscriptions, Billing, and Cancellations

SmartTagAI offers Free and paid Pro subscription tiers. Paid features, recurring billing, and free trial periods are managed through our payment infrastructure provider, Stripe.

• • Billing Cycle: Subscriptions renew automatically on a monthly or annual basis until canceled.
• • Cancellations: You may cancel your subscription at any time via your Account Settings. Your tier benefits will remain active through the end of the current paid billing period.

5. Acceptable Use Policy

You agree not to misuse the Service. Specifically, you agree NOT to:

• • Use the Service to post spam, unauthorized promotional content, or bulk automated messages in violation of platform rules.
• • Connect social media accounts for which you do not possess authorization to publish.
• • Generate or distribute content that is illegal, defamatory, harassing, abusive, or infringing on intellectual property.
• • Attempt to reverse engineer, exploit, or bypass rate limits or system security features of the Service or connected APIs.

6. Third-Party Platforms

Publishing and scheduling functionality depends on integration with third-party networks, including X, Bluesky, and Buffer. Your use of those platforms remains governed by their respective terms and policies. SmartTagAI is not responsible for platform downtime, API deprecations, rate limits, or account enforcement actions initiated by third-party services.

7. Intellectual Property & Rights

You retain full ownership of the prompts, text, and content you generate or submit using SmartTagAI. SmartTagAI retains all ownership rights, titles, and interests in and to the application software, trademarks, brand assets, and service architecture.

8. Termination

You may terminate your account at any time by contacting support or deleting your account via settings. We reserve the right to suspend or terminate your access immediately if you breach these Terms. Upon termination, stored user credentials and platform tokens will be revoked or removed in accordance with our Privacy Policy.

9. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. IN NO EVENT SHALL SMARTTAGAI BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF YOUR USE OF OR INABILITY TO USE THE SERVICE.

10. Governing Law

These Terms shall be governed and construed in accordance with applicable state and federal laws, without regard to conflict of law provisions.

11. Changes to These Terms

We may update these Terms from time to time. Material modifications will be communicated by updating the date at the top of this page or through an in-app notice prior to changes taking effect.
